一、提示条款

1.1 欢迎您使用「卡片编程（PLAYCODE CARD）」应用程序（以下简称"本软件"）！本软件由厦门牙牙信息科技有限公司（以下简称"我们"或"公司"）开发并提供服务。

1.2 请您在使用本软件前，审慎阅读、充分理解本协议各条款，特别是免除或限制责任的条款、法律适用与争议解决条款。如您为未成年人，请在监护人陪同下阅读本协议，并在取得监护人同意后使用本软件。

1.3 若您不同意本协议的任何内容，请您立即停止下载、安装、登录及使用本软件。

二、协议的确认与接受

2.1 您通过点击"同意并继续"、登录或实际使用本软件等行为，即视为您已阅读并同意本协议，本协议即在您与我们之间产生法律约束力。

2.2 您应确保具有相应的民事行为能力。如您不具备相应的民事行为能力，应在监护人的监护与指导下使用本软件。

三、服务内容

3.1 本软件是面向青少年及编程学习者的卡片式/积木式编程学习与实践平台，主要提供以下功能：

（1）课程与学习：课程套件选择、课节学习、场景任务、示例程序等；

（2）扫码识别：通过摄像头识别编程卡片或二维码，生成并运行指令程序；

（3）作品管理：创建、保存与管理"我的作品"；

（4）赛事活动：在符合条件时参与编程赛事/闯关活动；

（5）其他我们不时提供的功能。

3.2 您可以访问的课程内容由我们或授权方在后台为您配置的课程权限决定，未获得授权的课程无法访问。

3.3 本软件不提供向其他用户公开分享或公开展示作品的功能。

3.4 我们可能随时更新、调整或停止部分服务，具体以本软件实际提供的版本为准。

四、账号与登录

4.1 您需要使用手机号等方式登录会员账号后，方可使用课程、作品、赛事等需要登录的功能。

4.2 您应保证登录信息真实、准确、完整，并在信息变更时及时更新；不得使用虚假信息，亦不得冒用他人身份登录。

4.3 您应妥善保管账号、密码及验证码等登录凭证，并对账号项下的一切行为承担责任。发现账号被盗或异常，请立即通知我们。

4.4 我们有权对违反本协议或存在异常行为的账号采取限制、暂停或终止服务等措施。

五、用户行为规范

5.1 您在使用本软件时应遵守法律法规及本协议约定，不得从事下列行为：

（1）对本软件进行反向工程、反编译、反汇编或试图获取源代码（法律法规另有规定的除外）；

（2）利用本软件从事任何违法、侵权、损害他人权益或危害公共安全的活动；

（3）制作、复制、发布、传播违法、侵权、淫秽、暴力或其他不当内容；

（4）干扰、破坏或攻击本软件的正常运行、服务器或网络；

（5）在赛事等活动中作弊、刷分或以其他方式破坏活动公平性；

（6）其他违反法律法规或侵害他人合法权益的行为。

5.2 您对您保存的程序、作品及在软件内发布或提交的内容承担全部责任。

5.3 您在使用相机、存储、网络等系统权限时，应遵守平台规则与本协议约定。

六、知识产权

6.1 本软件及其中包含的课程内容、界面设计、文字、图片、图标、商标等知识产权归我们或相应权利人所有，受法律保护。

6.2 您在本软件中创作的指令程序、作品的知识产权归您所有。为向您提供作品保存、同步等服务，您授权我们在实现该等功能所必需的范围内对上述内容进行存储与处理。

6.3 未经我们或权利人书面许可，您不得复制、修改、传播或商业性使用本软件或课程内容的全部或部分。

七、第三方服务

7.1 本软件可能集成第三方SDK或跳转至第三方网站，以实现扫码识别、统计分析等功能。第三方服务由其运营方独立负责，其收集、使用个人信息的行为适用其自身的隐私政策。

7.2 因第三方服务或其内容产生的争议与责任，由您与第三方自行解决，我们将在法律允许的范围内提供必要协助。

八、免责声明

8.1 本软件按"现状"提供。我们不对以下情形承担超出法律规定的责任：因网络、设备、运营商等原因导致的服务中断、数据丢失或功能异常；因您操作不当、设备兼容问题或第三方原因导致的损失。

8.2 我们尽力保证课程内容准确，但不保证完全无误或满足您的特定预期。

8.3 在法律允许的范围内，我们不对间接损失、惩罚性赔偿承担责任。

九、协议的变更与终止

9.1 我们可能根据业务或法律法规变化修订本协议。修订后将在本软件内以适当方式公布。若您继续使用本软件，视为接受修订后的协议。

9.2 如您违反本协议，我们有权暂停或终止向您提供服务，并依法追究责任。

9.3 本协议终止后，您使用本软件的权利即告终止，但本协议中依其性质应继续有效的条款（如知识产权、免责声明、法律适用与争议解决等）继续有效。

十、法律适用与争议解决

10.1 本协议的订立、效力、解释、履行及争议解决均适用中华人民共和国法律。

10.2 因本协议引起的或与本协议有关的争议，双方应首先友好协商解决；协商不成的，任何一方均可向厦门牙牙信息科技有限公司住所地有管辖权的人民法院提起诉讼。

1. Notice

1.1 Welcome to the "PLAYCODE CARD" application (the "App"), developed and operated by Xiamen Yaya Information Technology Co., Ltd. ("we" or "the Company").

1.2 Please read this User Agreement ("Agreement") carefully, especially the provisions concerning limitation or exclusion of liability, governing law, and dispute resolution. If you are a minor, please read this Agreement with your guardian and use the App only with your guardian's consent.

1.3 If you do not agree to any part of this Agreement, please stop downloading, installing, logging in, and using the App immediately.

2. Acceptance

2.1 By clicking "Agree and Continue," logging in, or actually using the App, you acknowledge that you have read and agreed to this Agreement, which becomes legally binding between you and us.

2.2 You confirm that you have the relevant legal capacity. If you do not, you should use the App under the supervision and guidance of your guardian.

3. Services

3.1 The App is a block/card-based programming learning and practice platform for young learners, providing the following functions:

(1) Courses and learning: course kit selection, lessons, scene tasks, and sample programs;

(2) QR/card scanning: recognizing programming cards or QR codes via the camera to generate and run command programs;

(3) Project management: creating, saving, and managing "My Projects";

(4) Competitions: participating in programming competitions/challenges where applicable;

(5) Other functions we may provide from time to time.

3.2 The courses you can access are determined by the course permissions configured for your account; unauthorized courses cannot be accessed.

3.3 The App does not provide a feature to publicly share or display works to other users.

3.4 We may update, adjust, or discontinue some services at any time; the latest version of the App prevails.

4. Accounts

4.1 You must log in (e.g., with a mobile number) to use courses, projects, and competitions that require login.

4.2 You must provide true, accurate, and complete login information and keep it updated; you must not log in with false information or impersonate others.

4.3 You are responsible for safeguarding your account, password, and verification codes and for all activities under your account. Please notify us immediately if your account is compromised.

4.4 We may restrict, suspend, or terminate accounts that violate this Agreement or show abnormal activity.

5. Rules of Use

5.1 When using the App, you must comply with applicable laws and this Agreement and must not:

(1) Reverse engineer, decompile, disassemble, or attempt to obtain the source code (except as permitted by law);

(2) Use the App for any illegal, infringing, or harmful activity;

(3) Create, copy, publish, or transmit illegal, infringing, obscene, violent, or otherwise inappropriate content;

(4) Interfere with, disrupt, or attack the App's operation, servers, or network;

(5) Cheat, manipulate scores, or otherwise undermine fairness in competitions;

(6) Engage in any other conduct that violates laws or infringes others' rights.

5.2 You are solely responsible for the programs, works, and content you save or submit in the App.

5.3 When using system permissions such as camera, storage, and network, you must comply with platform rules and this Agreement.

6. Intellectual Property

6.1 The App and its course content, interface design, text, images, icons, and trademarks are owned by us or the respective rights holders and are protected by law.

6.2 You retain the intellectual property in the programs and works you create in the App. To provide project saving and syncing, you grant us the rights necessary to store and process such content for those purposes.

6.3 Without our or the rights holder's written permission, you must not copy, modify, distribute, or commercially use all or part of the App or course content.

7. Third-Party Services

7.1 The App may integrate third-party SDKs or link to third-party websites for features such as QR recognition and analytics. Such third-party services are independently operated by their providers, and their collection and use of personal information is governed by their own privacy policies.

7.2 Disputes arising from third-party services or content shall be resolved between you and the third party; we will provide reasonable assistance where permitted by law.

8. Disclaimer

8.1 The App is provided "as is." We are not liable beyond what is required by law for service interruptions, data loss, or malfunction caused by network, device, or carrier issues, or for losses caused by your improper operation, device compatibility issues, or third parties.

8.2 We strive to ensure the accuracy of course content but do not guarantee that it is error-free or that it meets your specific expectations.

8.3 To the extent permitted by law, we are not liable for indirect or punitive damages.

9. Changes and Termination

9.1 We may revise this Agreement based on business or legal changes. Revisions will be published in the App in an appropriate manner. Continued use of the App constitutes acceptance of the revised Agreement.

9.2 If you violate this Agreement, we may suspend or terminate your service and pursue legal remedies.

9.3 Upon termination, your right to use the App ends, but provisions that by their nature should survive (such as intellectual property, disclaimers, governing law, and dispute resolution) remain in effect.

10. Governing Law and Disputes

10.1 The formation, validity, interpretation, performance, and dispute resolution of this Agreement are governed by the laws of the People's Republic of China.

10.2 Any dispute arising from or relating to this Agreement shall first be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit in a competent court at the domicile of Xiamen Yaya Information Technology Co., Ltd.
